Terms of use

These terms are a licence agreement between whoever uses the Cartie app and Banuel Dogayman ("we"), who publishes it. Downloading or using the app means agreeing to them. If you do not agree, do not use the app.

In short

Cartie is offered on the App Store and Google Play. Where these terms say "the store", they mean the one the app was downloaded from. These terms are between us and whoever uses the app, not Apple or Google: neither is a party to them, owns the app, or is responsible for it or its content. For an App Store download, Apple's standard Licensed Application End User License Agreement does not apply; these terms apply instead, and section 19 explains what that means for Apple.

1What Cartie is

An app for family shopping lists, for any store: shared lists, an "I'm at the store" mode, templates, coupons, reminders, and stars and looks. The app is free. It has no purchases, no subscription and no ads. It is currently offered in Israel.

2Who can use it

Cartie is for people aged 13 and over. Anyone under 13 may not use it. Anyone under 18 uses it with a parent's or guardian's permission. Using the app confirms that this is the case.

3Your licence

We grant a personal, non-exclusive, non-transferable, revocable licence to install and use the app on a device you own or control. For an App Store download, that means any Apple-branded device, as permitted by the Usage Rules in Apple's App Store Terms of Service, including other accounts linked through Family Sharing where Apple allows it. For a Google Play download, any Android device, as permitted by the Google Play Terms of Service.

You may not copy, modify, distribute, sell, rent or sublicense the app; reverse engineer it or try to extract its source code, except where the law expressly allows it; remove any notice of ownership; or use it for anything unlawful.

4Users, accounts and sharing

  • Sign in. Sign in is with Apple or Google. Each person is responsible for their own phone and for who can open it.
  • Accounts. A person can be in up to 5 accounts, for example home and work, and an account can have up to 20 people. Each account is completely separate.
  • Who sees. On every list and coupon, "Who sees" decides who in the account sees it: "Whole account", "Specific people" or "Only me". Whoever sees a list can also change it. Whoever sees a coupon sees its code and can use, edit and delete it.
  • Invites. Anyone in an account can send an invite link. A link is valid for 7 days and 10 joins, and whoever opens it joins the account and sees what is shared with the whole account. Send it only to people who should be in the account.
  • Managing. The account's manager can rename it and remove people from it. Anyone can leave an account at any time. A person left alone in an account does not leave it but deletes it.

5Your content

What you write in the app stays yours. We take only the licence needed to run Cartie: to store the content, copy it between the phone and the server, and show it to the people it is shared with. We use it for nothing else. The licence ends when the content is deleted, except what stays in shared lists for other people in the account.

Acceptable use. Do not use Cartie to store or send content that is unlawful, abusive, harassing, threatening or that infringes anyone's rights; to share harmful links; to try to reach another account's data; or to overload or harm the service.

Reporting a problem. We do not review content in advance. Anything abusive or unlawful can be reported by email to banueldogayman@gmail.com, and we reply within a week. We may remove content or a user that breaks these terms. Inside an account, its manager can remove a person at once, and anyone can leave an account they do not want to be in.

6Stars and looks

  • Stars and looks are free. Stars are a reward inside the app, and there is no way to buy them with money: Cartie has no in-app purchases, no subscription and no ads.
  • Stars are earned only by shopping: a star for each item that was on the list when the trip started and went into the cart, plus 5 for finishing the trip, up to 100 a day per person. Undoing a finish takes back the stars it gave.
  • Stars are spent only on looks in the closet: hats, glasses, characters and list stickers. Looks are decoration only: they unlock no feature, and everything the app does is open to everyone without stars.
  • Stars are never sold, have no money value, and cannot be exchanged for money, goods or services. They belong to the person within each account and cannot be moved to another person or account.
  • They are deleted with the user. We may change the rules, how many stars a look takes, and the looks, and we will not take away stars already earned, except by undoing a finish.

7Coupons

Cartie stores what is typed or pasted into a coupon: the store, the code, the balance, the date, the link and the note. It does not issue, check or honour coupons. The balance in Cartie is what was entered there, not the balance at the store. Each coupon is subject to the terms of the store or whoever issued it.

We are not responsible for a coupon's validity, its balance, the date it expires, its loss, or its use by someone it is shared with.

8Test versions

A version distributed through TestFlight or a Google Play testing track is pre-release software. It may contain errors, may change or lose data, and may stop working when the test period ends or a newer version comes out. TestFlight's terms or Google Play's terms for testers also apply. Feedback sent to us may be used to improve the app, with no obligation to whoever sent it.

9Notifications

The app can send reminders set in it and updates for lists where updates are turned on. Notifications show the list's name and the items, so they appear on the lock screen. They can be turned off in the app or in the phone's settings at any time. Details are in the privacy policy, section 6.

10Our intellectual property

The app, its design, Cartie's cart and the characters, the stickers, the ready-made list of items, the text and the code belong to us or our licensors and are protected by copyright and other laws. Nothing in these terms gives any right in the app beyond the licence in section 3.

We, not Apple or Google, are responsible for dealing with any claim that the app infringes someone else's intellectual property rights, including investigating, defending, settling and discharging it.

11Maintenance and support

We, not Apple or Google, are responsible for maintaining and supporting the app. Neither Apple nor Google has any obligation to provide maintenance or support for it. Write to us at banueldogayman@gmail.com (support). We reply within a week, and we cannot promise that every issue will be fixed.

12Warranty

To the fullest extent the law allows, the app is provided as it is and as available, without any warranty, including that it will work without interruption, without errors, securely, or for any particular purpose.

For an App Store download: if the app fails to conform to any warranty that does apply, you may notify Apple, and Apple will refund the app's purchase price, if any was paid. To the fullest extent the law allows, Apple has no other warranty obligation of any kind for the app, and any other claim, loss, liability, damage, cost or expense arising from a failure to conform to a warranty is our responsibility.

13Product claims

We, not Apple or Google, are responsible for addressing any claim by a user or any third party relating to the app or its possession or use, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.

14Limits on our liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that the law does not allow to be excluded or limited.

Subject to that, and to the fullest extent the law allows, we are not liable for any loss of data, loss of profit, or any indirect or consequential loss arising from the app or these terms, and our total liability will not exceed what was paid to us for the app in the 12 months before the claim. Anyone using the app as a consumer keeps the rights the law gives them, including under Israel's Consumer Protection Law, and these terms do not take them away.

15Legal compliance

Using the app confirms that the user is not located in a country subject to a United States government embargo, or that the United States government has designated as a "terrorist supporting" country, and is not on any United States government list of prohibited or restricted parties. Every user agrees to comply with all export laws that apply to them.

16Third party terms

The app is distributed through the App Store and Google Play, so the terms of the store also apply to the download: Apple's App Store terms, or the Google Play Terms of Service. Signing in with Apple or Google is also subject to their terms. The app contains open source software used under its own licences, which impose no obligations on users. Every user agrees to comply with any third party terms that apply to their use of the app.

17Ending this agreement

You can end this agreement at any time by deleting the user (how to delete) and the app. We may end it, including by deleting the user, if these terms are broken in a way that matters, and Apple or Google may stop offering the app. When it ends, the licence in section 3 ends, and sections 5, 7, 10, 12 to 15 and 19 to 21 continue to apply.

18Changes

We may change the app, including adding, changing or removing features, and we may update these terms. New terms will appear here with a new date before they take effect. Continuing to use the app after that date means accepting them. If you do not, stop using the app; you can delete the user.

19Apple as a third party beneficiary

This section applies to an App Store download. Apple and Apple's subsidiaries are third party beneficiaries of these terms, and on acceptance of them Apple has the right, and is deemed to have accepted the right, to enforce them against the user as a third party beneficiary.

20Governing law and disputes

These terms, and any dispute arising from them or from the app, are governed by the laws of the State of Israel, without regard to its conflict of law rules. The competent courts of Tel Aviv-Yafo, Israel have exclusive jurisdiction over any such dispute. Anyone using the app as a consumer keeps every protection the law gives them, including the right to bring a claim in the court the law allows.

We will try to resolve any dispute directly first: write to us at banueldogayman@gmail.com, and we will reply within 30 days.
